An Engineering Degree Cannot Be Used To Close An Old Door To Promotion

Telangana changed its transport service rules in 2021 so that Administrative Officers needed an engineering degree to become Regional Transport Officers. The Chief Justice's bench has struck the change down.

The short answer

The Court held the State may prescribe higher qualifications, but only where they bear a rational nexus with the post. The RTO's role is primarily regulatory and managerial; the technical work belongs to Motor Vehicle Inspectors. The engineering requirement and the new vacancy split substantially curtail Administrative Officers' avenue without a rational basis, and are arbitrary, discriminatory and violative of Articles 14 and 16. Both were quashed.

What changed
  • The power to raise qualifications is real, but not unlimited. It must match what the post actually does.
  • Decades of practice counted. Legitimate expectation required the State to justify the sudden change, and it could not.
  • The 5-to-2 vacancy split fell too; vacancies go back to the 1994 rules.
  • Appointments already made are safe for now — none can be disturbed without notice and a proper order.

What the rule change did

Administrative Officers in district transport offices had for decades been a feeder category for appointment by transfer as Regional Transport Officer. The qualification was a university degree, which the petitioners hold.

An amendment of January 2021 to the Telangana State Transport Service Rules required them to hold a degree in mechanical or automobile engineering or equivalent instead. It also allotted 5 of every 10 vacancies to Motor Vehicle Inspectors and 2 to Administrative Officers, and provided that where no technically qualified Administrative Officer was available, the vacancy would go to the Inspectors.

The petitions challenged the change as beyond the State's power under Section 213 of the Motor Vehicles Act and as violating Articles 14 and 16.

Why the Court struck it down

The State does have power to prescribe qualifications, including ones higher than the Central Government's minimum. But that power is subject to the requirement of non-arbitrariness, and must bear a rational nexus with the nature and responsibilities of the post.

The Central Government has prescribed technical qualifications for the Motor Vehicle Inspector cadres, which exist to discharge specialised technical functions, and has not prescribed any for appointment by transfer as RTO. In this scheme the RTO functions primarily in a regulatory and managerial capacity.

Where the principal functions of the post are administrative and supervisory, one feeder category's technical qualification cannot justify curtailing the other's promotional opportunity. The State placed no material to show how the 5-to-2 split was arrived at, and showed no compelling public interest for so sudden and drastic a change to a long-standing avenue.

The directions

The engineering qualification for Administrative Officers was quashed to that extent as discriminatory, violative of Articles 14 and 16, and contrary to the statutory scheme under Section 213. The altered vacancy cycle was also quashed, and vacancies are to be dealt with under the 1994 rules.

The petitioners and similarly placed Administrative Officers are to be considered for appointment by transfer as RTO on the qualification in the pre-amended rules.

Appointments already made under the 2021 amendment are not to be disturbed, solely on account of this order, without notice to the persons affected and an order passed in accordance with law.

Frequently asked

Can the government change qualifications for promotion?

Yes, but the change must have a rational link to the post's duties and must not be arbitrary.

Do Administrative Officers need an engineering degree to become RTOs in Telangana?

No. The Court quashed that requirement; they are to be considered on the pre-2021 qualification.

Challenging a new qualification for promotion

  1. Compare the new qualification against what the promotional post actually does day to day.
  2. Show how long the old avenue existed; that grounds legitimate expectation.
  3. Ask the State to justify any vacancy ratio with material, not just cadre strength.
  4. Join those already promoted under the new rule, so relief is not delayed by a notice objection.
