How to Get a Legal Heir or Succession Certificate in Gujarat

When someone dies in Gujarat, the family often needs to prove who the heirs are before they can transfer land, draw a pension, claim provident fund or release a bank balance. There is no single document that does everything. Gujarat uses three different routes depending on what you are claiming. For inherited land, you get the Varsai mutation and a Pedhinamu (family tree) through the Mamlatdar and the e-Dhara system. For a pension, provident fund, insurance or a service claim, the Mamlatdar or taluka issues a legal heir certificate. For a bank balance, shares or other debts and securities, you usually need a succession certificate from the civil court under the Indian Succession Act, 1925, and where there is a will you may need probate. This page explains which route fits your claim, the documents, the fee, the timeline, and the civil court route when heirship is disputed. Last verified October 2026.

The short answer
  • Land: Varsai mutation and Pedhinamu through the Mamlatdar / e-Dhara; view the result on AnyROR.
  • Pension / PF / insurance: legal heir certificate from the Mamlatdar / taluka.
  • Bank balance / shares: succession certificate from the civil court under the 1925 Act.
  • A will: probate or letters of administration from the civil court where required.
  • If disputed: civil court for shares, probate for a contested will; Claw can track it.

01Three routes: which one you need

Match the route to what you are trying to claim. Using the wrong one wastes weeks.

What you are claimingRoute in Gujarat
Transfer of inherited agricultural landVarsai mutation and Pedhinamu through the Mamlatdar / e-Dhara
Pension, provident fund, gratuity, insurance, service duesLegal heir certificate from the Mamlatdar / taluka
Bank balance, fixed deposit, shares, other debts and securitiesSuccession certificate from the civil court
Assets under a willProbate of the will from the civil court, where required

A legal heir certificate lists the heirs for a claim; it does not decide ownership shares in a dispute. For that you need the court.

02Documents you need

Keep clear scans and originals ready:

DocumentWhy it is asked
Death certificate of the deceasedThe starting point for every route
Aadhaar and address proof of the applicant and all heirsIdentity and relationship
Relationship proof (ration card, school records, family register)To establish the family tree
Pedhinamu / affidavit of heirsA sworn statement of who the heirs are
Property or claim details (7/12, bank account, policy number)To tie the heirship to the asset

Use consistent name spellings across Aadhaar, the death certificate and the records. For a no objection among heirs, the heirs who are not applying often give a signed consent.

03Varsai and the legal heir certificate

Varsai (land mutation): apply at the e-Dhara centre in the Mamlatdar office or through the revenue service for mutation of the deceased holder to the heirs. The talati enters the Varsai in the village form 6 mutation register, a notice period runs, and if there is no objection the names are updated on the 7/12. You can view the updated Record of Rights on AnyROR.

Legal heir certificate: for a pension, provident fund, insurance or service claim, apply to the Mamlatdar or taluka, often through Digital Gujarat or the citizen service counter, with the death certificate, the Pedhinamu and the heirs proof. A Revenue official verifies and the certificate lists the heirs.

04Succession certificate and probate

For money assets the revenue certificate is often not enough. A bank, a depository or a company will usually ask for a succession certificate from the civil court under the Indian Succession Act, 1925 before it releases a balance, a deposit or shares. You file a petition in the district court that has jurisdiction, the court issues a public notice, and after the notice period and court fee it grants the certificate to the heirs.

Where the deceased left a will, the executor may need letters of administration or probate of that will from the civil court, depending on the asset and the place. If the deceased was Hindu and left no will, the shares follow the rules of intestate succession.

05Fee, timeline and common problems

The revenue Varsai and legal heir certificate carry a small fee and are usually done in a few weeks if there is no objection. A succession certificate from the civil court takes longer, often a few months, because of the public notice, and the court fee is a percentage of the value of the assets covered.

Common problems are a name or relationship mismatch across records, an heir left out of the Pedhinamu, a pending Varsai that holds up a land transfer, and using a legal heir certificate where the bank actually wants a succession certificate. Pick the right route first.

06If heirship is disputed: the court route

Heirship turns into litigation more often than families expect. An heir may be left out, a second family may surface, a will may be challenged as forged or made under pressure, or siblings may fight over shares in the land or the house. These are civil matters. A dispute over shares, partition or possession goes to the civil court that has jurisdiction, a contested will is tested in a probate or testamentary proceeding, and a Varsai or mutation fight can run through the revenue authorities and up to the revenue courts. Where a legal right is denied a writ petition lies in the Gujarat High Court.

08Frequently asked questions

Is a legal heir certificate the same as a succession certificate in Gujarat?

No. The legal heir certificate from the Mamlatdar lists heirs for a pension, provident fund or insurance claim. A succession certificate is granted by the civil court for debts and securities like bank balances and shares. Banks usually insist on the court certificate.

How do I transfer inherited land?

Apply for Varsai mutation at the e-Dhara centre in the Mamlatdar office with the death certificate and the Pedhinamu. After the notice period the heirs names are entered on the 7/12, which you can view on AnyROR.

What is a Pedhinamu?

A Pedhinamu is the family tree of the deceased, sworn by the heirs, used to establish who the heirs are in both the revenue and the claim process.

Do I need probate?

Where the deceased left a will, the executor may need probate or letters of administration from the civil court, depending on the asset and place. For a Hindu who left no will, the shares follow the rules of intestate succession.

What if an heir is left out or a will is challenged?

A dispute over shares or partition goes to the civil court, and a contested will is tested in a probate proceeding. Claw can track that matter across the forum that hears it.
