How to Get a Legal Heir or Succession Certificate in Maharashtra

When a family member dies, you often need an official document that says who the heirs are so you can claim dues and transfer assets. In Maharashtra there are three different documents for three different needs, and people often mix them up. A legal heir certificate (varsa praman patra) from the revenue office is enough for pension, provident fund, gratuity and utility transfers. A succession certificate from the civil court is for collecting the deceased person debts and movable securities like shares and bank deposits where there is no will. Probate or letters of administration from the court is for giving effect to a will, and in the Mumbai area a will of immovable property needs probate. This page explains which document you actually need, who issues each one, the documents and the timeline, and the court route when heirship or the estate is disputed. Last verified October 2026.

The short answer
  • Legal heir certificate: from the Talathi / Tehsildar on Aaple Sarkar, for pension, PF, gratuity, utility transfer.
  • Succession certificate: from the civil court, for debts and movable securities with no will.
  • Probate: from the civil court, to give effect to a will; needed for immovable property in the Mumbai area.
  • Need: death certificate, heir identity and relationship proof, and for court routes a petition and court fee.
  • If disputed: the civil court or Bombay High Court decides heirship and shares; Claw can track the matter.

01Three documents, three different needs

Pick the right one for your need, because applying for the wrong one wastes weeks.

  • Legal heir certificate (varsa). From the revenue office (Talathi or Tehsildar). Lists the surviving family members. Used for pension, PF, gratuity, salary dues and transfer of a utility connection.
  • Succession certificate. From the civil court under the Indian Succession Act 1925. Needed to collect the deceased person debts and movable securities, like bank deposits, shares and mutual funds, when there is no will.
  • Probate or letters of administration. From the civil court under the Indian Succession Act 1925. Probate proves a will; letters of administration are granted when there is no executor or no will. In the Mumbai, Kolkata and Chennai areas, a will of immovable property needs probate.

For the detail of each court document, see the succession certificate explainer and the probate of a will explainer.

02Documents you need

The core set is similar; the court documents need more.

DocumentWhy it is asked
Death certificate of the deceasedProof of death, needed for every route
Identity and address proof of each heir (Aadhaar)To identify the heirs
Proof of relationship (ration card, school records, family tree)To show who the heirs are
Self declaration or affidavit of the heirsSworn statement of the heirs and the assets
The will, if anyFor probate or letters of administration
List of assets, debts and securitiesFor a succession certificate

For the court routes you will also file a petition with details of all heirs, the assets and their value, because the court fee and the notices depend on the value of the estate.

03How to apply for each

The revenue certificate is online; the court documents are filed in court, usually through a lawyer.

  • Legal heir certificate. Apply on Aaple Sarkar under the Revenue Department, or at the Tehsil office. Attach the death certificate, heir identity and relationship proof. The Talathi verifies and the Tehsildar issues it.
  • Succession certificate. File a petition in the District Court that has jurisdiction, with the list of debts and securities. The court publishes a notice, hears objections and then grants the certificate.
  • Probate or letters of administration. File a petition in the District Court, or on the original side of the Bombay High Court within its ordinary civil jurisdiction, with the will. The court issues citations, hears objections and then grants probate or letters of administration.

04Fee, court fee and timeline

The legal heir certificate carries only a small portal or revenue fee. The court documents carry a court fee on the value of the estate, which in Maharashtra is a percentage of the value up to the ceiling the court fee law sets.

A legal heir certificate usually issues within a few weeks once the Talathi verifies. A succession certificate or probate takes longer, often a few months, because the court must publish notice and wait for objections. If someone files an objection, it becomes a contested matter and can take much longer.

Apply early, because banks, the PF office and the registrar will not release assets or transfer property until you produce the right document.

05Which one does the asset holder want

Ask the asset holder in writing what they need before you apply, so you do not get the wrong document.

  • Pension, PF, gratuity, salary dues, utility transfer: usually the legal heir certificate.
  • Bank deposits, shares, mutual funds and debts with no will: usually a succession certificate.
  • Giving effect to a will, especially for immovable property in the Mumbai area: probate.

06Common reasons it is rejected or delayed

Most problems are fixable. The usual grounds are:

  • Name or relationship does not match across the death certificate, Aadhaar and ration card.
  • An heir is left out of the application, which can make the certificate challengeable later.
  • The wrong document chosen, so the bank or registrar refuses it.
  • In court, an objection filed by another claimant, which turns a simple grant into a contest.

If the problem is paperwork, fix it and re-apply. If heirship itself or the estate is contested, the court route below applies.

07If heirship or the estate is disputed

A legal heir certificate from the revenue office settles nothing if the family disagrees about who the heirs are or how the estate should be shared. The real decision then moves to the civil court. A succession certificate petition, a probate or letters of administration petition, or a partition suit for the property is where heirship and shares are decided, under the Indian Succession Act 1925 and the personal law that applies to the deceased. In the Mumbai area the original side of the Bombay High Court hears testamentary and succession petitions above the District Court limit. Objections, caveats and cross claims are common, so these matters often run long.

09Frequently asked questions

What is the difference between a legal heir certificate and a succession certificate in Maharashtra?

A legal heir certificate from the revenue office lists the heirs and is enough for pension, PF, gratuity and utility transfers. A succession certificate from the civil court is needed to collect the deceased person debts and movable securities like bank deposits and shares when there is no will.

Where do I apply for a legal heir certificate?

On Aaple Sarkar under the Revenue Department, or at the Tehsil office. The Talathi verifies the family and the Tehsildar issues the certificate.

Do I need probate for a will in Mumbai?

In the Mumbai area a will of immovable property generally needs probate from the court. Probate proves the will and lets the executor deal with the estate.

How long does a succession certificate take?

Usually a few months, because the court must publish notice and wait for objections. If someone objects, it becomes a contested matter and takes longer.

What if the family disputes who the heirs are?

Heirship and shares are then decided by the civil court through a succession, probate or partition matter, under the Indian Succession Act 1925 and the personal law that applies. In Mumbai the Bombay High Court original side hears larger testamentary petitions. Claw can track that matter.
