How to Register Property and Apply for Mutation in Jammu Kashmir
Registering property in the Union Territory of Jammu and Kashmir changed significantly after 2019. Following the Jammu and Kashmir Reorganisation Act 2019, central laws including the Registration Act 1908 apply in the UT in place of the former state enactments, and the earlier restriction that only permanent residents could buy land was removed for non-agricultural land, so the process is now closer to the rest of India. As elsewhere, there are two stages people confuse: registration of the sale deed before the Sub-Registrar, which transfers title, and mutation (intkal), which updates the revenue record (the Fard) to show you as the owner. You need both. This page explains the current legal position, how to pay stamp duty and register a sale, how to get mutation done, how to confirm the record, and what to do if a mutation is wrong or a boundary or ownership dispute starts. Last verified October 2026.
- Post-2019: central laws including the Registration Act 1908 apply in the UT of J&K.
- Who can buy: the permanent-resident restriction was removed for non-agricultural land; agricultural land still has limits.
- Two stages: register the sale deed before the Sub-Registrar, then get mutation (intkal) in the Fard.
- Stamp duty: paid on consideration or circle rate, whichever is higher, usually by e-stamping.
- Disputes: a wrong mutation or title fight goes to the revenue courts or the civil court.
01What changed after 2019
The legal framework for property in J&K was reset after the Reorganisation Act 2019:
- Central laws including the Registration Act 1908 and the Transfer of Property Act now apply in the UT, replacing the former state Acts.
- The earlier bar that only a permanent resident could buy land was removed for non-agricultural land, so buyers from outside J&K can now purchase such land.
- Agricultural land still carries restrictions on who can buy it and for what use, so always check the land's classification first.
Because the framework changed recently, confirm the current rule for the specific land type (agricultural or non-agricultural) and any permission needed before you commit.

02Step 1: stamp duty and the sale deed
Once title is clear and the land type is confirmed:
- Get the sale deed drafted with the correct description, area, boundaries and Khasra or Khewat numbers.
- Pay stamp duty and the registration fee on the consideration or the circle rate, whichever is higher.
- Stamp duty is generally paid through e-stamping.
03Step 2: register before the Sub-Registrar
The sale deed is registered under the Registration Act 1908 before the Sub-Registrar for the area (often the Tehsildar or a designated revenue officer in J&K).
- Buyer and seller attend with two witnesses and identity proof (Aadhaar, PAN).
- Carry the stamped sale deed, the latest Fard and mutation, the plot plan where required, and proof of stamp duty.
- Photographs and biometrics are captured, and the registered deed is returned to you.
Registration makes the transfer legally valid, but it does not automatically change the revenue record. That is the next step.
04Step 3: apply for mutation (intkal)
Mutation (intkal) records you as the owner in the Fard:
- After registration, apply for mutation at the Patwari or Tehsildar office with a copy of the registered deed.
- The Patwari enters the mutation and the revenue officer (Tehsildar) attests it after hearing anyone who objects.
- Once attested, the Fard is updated to show you as the owner.
Mutation is not proof of title on its own, but skipping it is a common cause of later disputes, so complete it promptly after registration.
05Step 4: confirm the record
After mutation, confirm the change is reflected:
- Pull the updated Fard through the J&K land-records portal or from the Patwari.
- Check your name, share, Khasra and area are correctly recorded.
- Keep the registered deed, the mutation order and the updated Fard together as your title set.
06Common problems
- Wrong land classification, buying agricultural land that carries a restriction.
- Mutation not done or wrongly attested, leaving the Fard in the seller's or a third party's name.
- Boundary or area mismatch between the deed, the plan and the record on the ground.
- Undisclosed co-owners or inheritance claims not reflected in the Fard.
Most of these are caught by reading the Fard and the mutation chain, and the title history, before you pay.
07Tracking a title or mutation dispute with Claw
Claw is an all-in-one legaltech platform for Indian advocates, law firms, and corporate legal teams, combining AI-based case search, an AI legal assistant (Legal GPT), case management, and compliance automation across all Indian courts and tribunals.
A wrong mutation, a question over land classification, or a boundary or ownership fight does not stay on the portal; it goes to the revenue courts (Tehsildar, Deputy Commissioner and the Divisional or Financial Commissioner) or to the civil court for a declaration of title and injunction. Each becomes a matter with a number, hearing dates and orders. You can create a FREE Claw account and track that suit through every listing and order. Claw covers 9,102 courts, benches and forums, including the civil and revenue courts and the High Court of Jammu and Kashmir and Ladakh, so your property dispute has a real tracking home, and judgment search across 30 crore+ judgments (Supreme Court from 1950, High Courts from 1990) with results in under 5 seconds lets a lawyer read how similar mutation and title matters were decided. A clean search only means nothing was found on the forums and date searched, so treat it as an input, not legal advice.

09Frequently asked questions
Can anyone buy property in Jammu and Kashmir now?
After the Jammu and Kashmir Reorganisation Act 2019, the earlier restriction that only permanent residents could buy land was removed for non-agricultural land, so buyers from outside J&K can purchase such land. Agricultural land still carries restrictions on who can buy it and for what use, so check the land classification first.
What law governs property registration in J&K now?
Central laws, including the Registration Act 1908 and the Transfer of Property Act, now apply in the Union Territory in place of the former state Acts. Registration of the sale deed before the Sub-Registrar transfers title, and the process is close to the rest of India.
What is the difference between registration and mutation?
Registration is signing the sale deed before the Sub-Registrar after paying stamp duty, which transfers title. Mutation (intkal) updates the revenue record (the Fard) to show you as the owner. Registration transfers title; mutation updates the record. You need both.
How do I get mutation done in J&K?
After registration, apply at the Patwari or Tehsildar office with a copy of the registered deed. The Patwari enters the mutation and the Tehsildar attests it after hearing any objections, and the Fard is then updated. Complete it promptly, since skipping mutation is a common cause of later disputes.
Where does a property dispute in J&K go?
To the revenue courts (Tehsildar, Deputy Commissioner and the Divisional or Financial Commissioner) or to the civil court for a declaration of title and injunction, and ultimately the High Court of Jammu and Kashmir and Ladakh. Each becomes a case with a number and hearing dates that you can track.
