How to Remove a Wrongful Default From Your Credit Report (2026)
A default on your credit report is the single most damaging entry it can carry. A loan marked as defaulted, written off, settled or non-performing can get your next loan refused outright or priced far higher, and it can sit on the report for years. When that default is wrong, you have a legal right to get it removed, and a clear process to force the correction. This guide is specifically about a wrongly reported default, the kind of error that does the most harm, and how to remove it: the law behind your right, the dispute with the bureau and the lender, the time limit and compensation for delay, and how to escalate. It is general information, not legal or financial advice. Last verified October 2026.
- Why it matters: a default, write-off, settled or non-performing tag is the most damaging credit-report entry, so a wrong one is worth removing urgently.
- Your right: the Credit Information Companies (Regulation) Act, 2005 and the 2006 Rules require accurate reporting and correction of errors.
- How: dispute with the bureau and, in parallel, the lender who reported the data, with proof such as a no-dues or closure letter.
- Time and compensation: resolution within 30 days, with Rs 100 per day of delay under the RBI framework (effective 26 April 2024).
- Escalate: grievance officers, then the RBI Integrated Ombudsman, then the consumer commission for real loss.
01Why a wrong default is special
Not all credit-report errors are equal. A wrong address or a slightly wrong balance rarely changes a lending decision. A default does. A default, write-off, settled or non-performing tag tells every future lender that you did not honour a debt, which is exactly the signal that gets a loan refused. That is why removing a wrongful default is worth the effort it takes, and why you should treat it as urgent rather than wait for it to age off.
There is also a difference between a wrong default and a real one. A real default cannot simply be deleted on request; you clear the dues, ask the lender to update the status, and the history ages over time. This guide is about the wrong default, an entry that is factually incorrect, which you are entitled to have corrected or removed.
A real default must age off after you clear it. A wrong default you are entitled to have corrected or removed, and you should treat it as urgent.
02The common wrongful-default errors
Wrongful defaults usually come from a handful of situations. Check which one is yours, because your proof depends on it:
- Paid loan still marked default. You cleared the loan, but the lender never updated the status to closed.
- Settled shown wrongly, or settlement never agreed. A loan you paid in full is marked “settled” (which looks worse), or a settlement is recorded that you never accepted.
- Someone else's default on your report. An identity or name mix-up, common with similar names, or after a data error at the lender.
- Default after closure. A default reported for a period after you had already closed the account.
- Guarantor or co-applicant wrongly tagged. You are shown as the defaulter on a loan where your role or liability was different.
- Default on a loan you never took, which may point to fraud or a lender error.
Whatever the cause, the fix is a dispute backed by proof, raised with both the credit bureau and the lender who reported the data.
03Your right to correction and the law
Your right to a correct credit record is backed by law. The Credit Information Companies (Regulation) Act, 2005 and the Credit Information Companies Rules, 2006 govern how credit information companies (the bureaus, such as CIBIL, Experian, Equifax and CRIF High Mark) and credit institutions (banks and NBFCs) collect and report your data, and they require that the information be accurate and that errors be corrected.
Because the lender is the source of the data, a correction has to reach both the bureau and the lender. The bureau cannot change what a lender reported without the lender confirming the correction. That is why a successful removal almost always involves disputing with both at the same time.
04How to get it removed, step by step
The route to remove a wrongful default is:
- Get your full report from the bureau and identify the exact account, the default status, and the dates. Note precisely what is wrong, for example “closed on 10 June but shown as default”.
- Collect the proof that defeats the default: the no-dues or closure letter, the final payment receipt, the bank statement showing clearance, or the lender's email confirming closure. For an identity mix-up, your identity documents.
- Raise an online dispute with the bureau for the specific account, selecting the default field, and describe the error.
- Write to the lender in parallel, by email and through its grievance channel, asking it to correct the status with the bureaus and to confirm the closure. The lender is the source, so this step is essential.
- Track the correction. The field is usually marked under dispute while the bureau confirms with the lender. If the error is confirmed, the record is corrected.
- Download a fresh report and confirm the default is gone, and that the account shows the correct status.

05The time limit and compensation for delay
You are not at the mercy of an open-ended process. Under the RBI framework for credit information, a complaint about a credit record should be resolved within 30 calendar days. Within that, the credit institution is given a window to respond to the bureau and the bureau has the balance of the days to finish.
The RBI has also put a price on delay. By its circular of 2023 (effective 26 April 2024), if the complaint is not resolved within 30 days, the complainant is entitled to compensation of Rs 100 for each day of delay, to be credited within a few working days of resolution. Liability falls on whoever caused the delay, the lender or the bureau. Keep every reference number and date, because this clock, and the compensation, run from your complaint. Confirm the current framework on the RBI site, as the detail is updated from time to time.
06If it is still not removed: escalate
If the 30 days pass and the default is still there, or your dispute is rejected without a proper reason, move up a step at a time.
- Grievance officers. Write to the lender's nodal officer and the bureau's grievance officer, quoting your earlier references.
- RBI Ombudsman. Under the Reserve Bank Integrated Ombudsman Scheme, 2021, file a free online complaint on the RBI complaint portal if the regulated entity did not resolve it or reply in time, usually after you complained first and waited about 30 days. See filing an RBI banking ombudsman complaint.
- Consumer commission. If the wrong default caused you real loss, such as a refused loan or a higher interest rate, file a consumer complaint for deficiency in service, and track the consumer case on e-Jagriti. The commission can order correction and compensation.
- Court, only if needed. For serious cases, such as large loss or fraud, speak to an advocate about a civil remedy.
07Where Claw fits
Most wrongful defaults are removed through the bureau and lender with a good paper trail, and never become a case. Claw is relevant only if your dispute turns into a formal proceeding. Claw is an all-in-one legaltech platform for Indian advocates, law firms, and corporate legal teams, combining AI-based case search, an AI legal assistant (Legal GPT), case management, and compliance automation across all Indian courts and tribunals.
If a lender will not remove a wrong default and you escalate to the RBI Ombudsman or a consumer commission, you can track the resulting matter and any connected banking or recovery proceeding by party name, so a hearing date or an order reaches you through alerts and monitoring, across 9,102 courts, benches and forums. To see how consumer commissions and courts have treated wrong credit reporting and deficiency-in-service claims, its Legal GPT researches across 30 crore+ judgments, with Supreme Court decisions from 1950 and High Court decisions from 1990. Results return in under 5 seconds, and Claw does not train its AI models on your documents. To check what else is on record for a party, you can run a case search across Indian courts by name. For how a litigation check differs from a credit report, see litigation check vs a CIBIL credit report. A clean result means nothing was found on the forums and date searched, under the names used, not that no matter exists. This is general information, not legal or financial advice.

09Frequently asked questions
How do I remove a wrongly reported default from my credit report?
Download your report and identify the exact account and default status, collect proof such as a no-dues or closure letter and payment receipts, then raise an online dispute with the credit bureau and write to the lender in parallel asking it to correct the status. The lender is the source of the data, so both steps matter. Once confirmed, the record is corrected.
Can a default be removed from CIBIL if it is wrong?
Yes. If the default is factually wrong, for example a paid loan still marked default, a settlement you never agreed to, or someone else's default on your report, you are entitled to have it corrected under the Credit Information Companies (Regulation) Act, 2005. A real default cannot simply be deleted; you clear the dues and the history ages over time.
How long does it take to remove a wrong default?
A credit record complaint should be resolved within 30 days under the RBI framework. If it takes longer, you are entitled to compensation of Rs 100 for each day of delay under the RBI circular effective 26 April 2024, credited within a few working days of resolution. Keep every reference number and date.
What is the difference between settled and closed on a credit report?
A loan marked closed means you paid it in full and the lender closed it cleanly. Settled means the lender accepted less than the full amount, which looks worse to future lenders. If you paid in full but the report shows settled, that is an error you can dispute and ask the lender to correct to closed.
What if the lender refuses to remove the wrong default?
Escalate step by step: write to the lender's nodal officer and the bureau's grievance officer, then file a free complaint with the RBI Ombudsman under the Integrated Ombudsman Scheme, 2021 if it is not resolved or answered in time. If the wrong default caused you real loss, you can also approach the consumer commission for deficiency in service, which can order correction and compensation.
