Officers Barred From Promotion By A Degree Requirement Lose Their Challenge
Extension wing officers in Nagaland's land resources department found the rules kept them out of promotion to Deputy Director because of the subject of their degree. The High Court has upheld the rules.
The Court held that educational qualification is a permissible basis of classification for promotion where it has a rational nexus with the higher post, following Triloki Nath Khosa and Mohammad Shujat Ali. A qualification may be distinguished by subject as well as level. An employee's right is to be considered under the rules, not to claim promotion outside them, and a writ court cannot substitute its own view of what qualification should have been prescribed.
- The rule-making authority chooses the qualification, not the court.
- The subject of a degree can matter, not just how high it is.
- Overlap between two wings at one level does not make them equal for promotion.
- Experience cannot replace a prescribed technical qualification.

The challenge
The petitioners are members of the Extension Wing of Nagaland's Land Resources Development Department. They challenged Schedule II of the department's 2008 rules, which prescribes an educational qualification for promotion to Deputy Director and above that they do not hold.
Their argument was that the two wings meet at the level of District Project Officer, that their functions overlap, and that officers are even transferred between them, so treating them differently for further promotion offends Articles 14 and 16.
Why the rules were upheld
Chief Justice Ashutosh Kumar and Justice Arun Dev Choudhury held the classification rests on an intelligible basis, the qualification prescribed for the higher post, and that it bears a rational nexus with the specialised knowledge needed at that level.
Constitution Bench decisions in Triloki Nath Khosa and Mohammad Shujat Ali establish that educational qualification may found a classification for promotion. A qualification may also be distinguished by its subject, not only its level, where that has a rational relation to the duties of the post.
That the two wings meet at one level, or that an officer has long administrative experience, does not confer eligibility contrary to the rules. The right of an employee is to be considered for promotion in accordance with the rules.
The limits of judicial review
The Court said the wisdom of prescribing a particular technical qualification is for the rule-making authority, and a writ court cannot substitute its own opinion on what ought to have been prescribed.
The petitioners having shown nothing to make the qualification manifestly arbitrary or irrational, the challenge failed and the petition was dismissed, with parties bearing their own costs.
Who argued it
Appearances as recorded in the judgment of the Court.
Frequently asked
Can rules demand a particular degree subject for promotion?
Yes, where the requirement has a rational nexus with the duties of the higher post.
Can a court change the qualification it thinks is better?
No. That choice belongs to the rule-making authority.
Challenging a promotion qualification
- Read the rule and identify exactly what qualification it demands.
- Ask what the higher post actually requires by way of knowledge.
- Show, with material, that the requirement has no rational connection.
- Remember experience alone will not substitute for the qualification.
