A single writ about the care of one temple elephant produced directions covering every captive elephant in Tamil Nadu. The Chief Justice's bench has separated the two.
The Court set aside the blanket directions — those transferring all captive elephants, temple-owned and privately owned, to Government Rehabilitation Camps, and instructing the Hindu Religious and Charitable Endowments Department to tell all temples in Tamil Nadu not to acquire any elephant. The two kinds of direction
The order under appeal, of 27 February 2023, dealt with the elephant Lalitha — her custody, her medical treatment, her retirement under Rule 10, the continuation and payment of her mahout and his assistant, access to her by a named animal welfare volunteer, and a direction to the jurisdictional police to keep her surroundings free of noise pollution.
It went further and directed the transfer of all captive elephants — temple-owned and privately owned alike — to Government Rehabilitation Camps, and directed the Secretary of the Hindu Religious and Charitable Endowments Department to instruct every temple in Tamil Nadu not to acquire any elephant.
